On Friday, October 20, the changes to the Criminal Law developed by the Ministry of Justice come into force, increasing the criminal penalty for organizing the flow of illegal migrants, thereby strengthening the security of the state and society in the conditions of hybrid threats. In the future, criminal liability will also be strengthened for helping persons illegally crossing the state border to stay in the Republic of Latvia, as well as to move within the state territory.
Minister of Justice Inese Lībiņa-Egnere states: “Harder punishments for the organizers of the flow of migrants, who blatantly violate the law of the Republic of Latvia for greedy purposes and illegally transport unidentified persons, are a tool to strengthen the security of the state and society. I would like to emphasize once again that there are militarily aggressive countries next to Latvia, which are currently developing a hybrid threat against us, so any kind of cooperation with the regimes of Russia and Belarus will be assessed and punished accordingly. The changes in the Criminal Law envisage both more severe punishment of those who violate the law, as well as preventive measures to deter them from committing criminal offenses.”
Similarly, in the future, the Criminal Law stipulates to increase the amount of custodial sentences and to exclude the alternative punishment for custodial imprisonment – community service, because this type of punishment is insufficient to deter persons from committing a criminal offense directed against the national borders and territorial security.
The hybrid attack organized by Belarus floods the neighboring countries with streams of migrants and artificially creates a migration crisis on the Latvian border. There is still a significant number of migrants in Belarus who want to get to the EU, illegally crossing the border between the Republic of Latvia and the Republic of Belarus. The large number of people who want to cross the national border also creates tempting conditions for those who want to organize or implement the relocation of illegal immigrants within the EU, that is, to ensure their unauthorized stay in Latvia or another EU member state.
