Four Cologne restaurateurs wanted to bid on an excursion boat for 75,050 euros. But there’s a catch: the seller refuses to release it. Now there is a second attempt in court.
On Tuesday next week, the Düsseldorf regional court wants to make a new attempt in the dispute over the auctioned excursion ship “MS Stadt Düsseldorf” and make up for the trial date planned for last December.
The dispute is about a 51-year-old ship of the “White Fleet” from Düsseldorf. Four Cologne restaurateurs bought it at an online auction a year ago for 75,050 euros. You are of the opinion that you have concluded a legally valid sales contract with the award. But the “White Fleet” as the defendant contradicts this and refuses to hand over the ship.
The reason: You yourself have offered a prohibited article, so the auction did not run properly. A ship, like land, cannot be auctioned on eBay. In addition, one forgot to indicate a mortgage on the ship in the description.
The shipping company wanted to thin out the fleet after the corona-related drop in demand and part with one of its four ships. According to unconfirmed media reports, the company had probably hoped for significantly higher proceeds of up to 400,000 euros.
