The operator of a Greek restaurant had taken out business closure insurance and demanded 24,000 euros for his loss of earnings in the first lockdown.
The judge thinks wrongly. According to the contract, the insurance only covers the consequences of diseases that were already mentioned in the Infection Protection Act in 2000. Covid 19 had not yet existed. So in his case there is no entitlement to compensation.
Many restaurateurs complain
According to the Hotel and Restaurant Association NRW, the Neuss restaurateur is not an isolated case. Numerous restaurateurs have sued against default insurers unwilling to pay. The association was unable to provide specific figures.
