Nepal’s Supreme Court Issues Interim Order for Temporary Registration of Same-Sex Marriage

Kathmandu: The Supreme Court of Nepal issued an interim order directing the government to temporarily register same-sex marriages. Justice Til Prasad ordered the Hon’ble government to make arrangements to register the marriage if the couple so requests.

Seven people, including activist Pinnaki Gurung, have written to the Prime Minister and the Cabinet Council Office demanding the legalization of same-sex marriage. The Supreme Court asked the government to respond in writing within 15 days. The petitioners say that they have approached the court because the Nepalese law prevents same-sex marriages even though the Supreme Court allowed same-sex marriages 15 years ago.

The petitioners called for same-sex marriage to be legalized citing passages such as Section 69(1) which states that all citizens are free to marry and Section 18(1) that all are equal before the law.

Pinki Gurunk told the media that same-sex marriages can be registered until the same-sex marriage law is enacted. PTI reported that they approached the Supreme Court with their demand because the Supreme Court had given permission for same-sex marriage but it was not implemented in the absence of a special law.
