Navigating the Murky Waters of AI and Copyright Law: Updates from the US Patent Office

Right now, we’re all still trying to navigate the murky sea that is AI and copyright law. For example, The New York Times is suing Microsoft and OpenAI for using NYT articles. The adoption of generative AI was unprecedented, so government authorities are trying to find some strict and sensible laws for its use. Well, the US Patent Office has announced that updates to AI copyright laws will be issued.

When it comes to legislating new technologies, it can be quite rough. More recently, the EU has started to develop some real laws related to artificial intelligence. Companies and countries in the EU will have to start implementing these laws within the next couple of years.

The US Patent Office will publish updates on its anti-artificial intelligence laws

The Patent Office announcement does not actually provide any hard and fast rules. Still, it’s a small checkpoint that lets us know what the office plans to do and when it plans to put the legislature on paper. The office is about to publish a detailed report on copyright law.

First, the report will touch on topics such as digital copies. This includes using AI to replicate a person’s voice, artistic style and other aspects of a person’s identity. This is probably one of the biggest gripes people have about AI. Many people, especially public figures, fear the idea of their identity being replicated and warped by AI and published to the world.

Second, the report will address the copyright of works created using AI. So if a person creates a song using artificial intelligence, the question remains whether that person can legally copyright that work and call it their own, even if they didn’t. This section will be published separately from the first. The US Patent Office plans to issue it by the end of summer 2024.

Additional reports

The US Patent Office will separately publish an update to the US Copyright Office Compendium of Practice. This update will provide people with guidance and examples of jobs that contain AI-generated material. This will help people better understand what types of works can and cannot be protected by copyright. Prior to publishing this report, the Bureau will issue a public notice requesting comments on this matter.

Finally, the patent office convened a panel of academic and government economists to discuss the potential economic impact of copyright and AI. They will publish their findings later. The US Patent Office plans to have it all worked out by the end of the 2024 fiscal year. So we’ll get more information as the year goes on.
