National Institute of Music Revokes Purchasing and Contracting Instructions: Updates for Efficiency and Transparency

HAVING SEEN File No. 1/2024/INAMU, Laws 26,801 and 24,156, Resolutions No. 193/2023/INAMU, 178/2022/INAMU, and

CONSIDERING:

That Law 26,801, in its article 5, establishes the legal nature of the National Institute of Music, as a non-state public entity, governed by its own Statute and Internal Regulations prepared by the Board of Directors and approved by the Federal Assembly, and by the regulations that are applicable to it in accordance with its legal nature, object and functions.

That through Resolution 193/2023/INAMU, the Statute of the National Institute of Music was approved, ratified by the Federal Assembly.

That article 3, paragraphs 7) and 13) of the Statute, establishes among the powers of the Board of Directors “to approve the administrative procedures that regulate institutional development” and “to authorize the processes of acquisition and contracting of goods and services.”

That through Resolution 178/2022/INAMU, the current Purchasing and Contracting Instructions were approved, which are applied to the purchase of goods, contracts and services linked to the development of the activities carried out at the INAMU.

That the Administration Area expresses the need to modify the Purchasing and Contracting Instructions, in order to adapt the Instructions to the reality of our Institute.

That the current text was inspired by Decree No. 1030/2016 on the Contracting Regime of the National Administration, with the pertinent adaptations and inclusions, although the nature of INAMU as a non-state public entity makes some of the established procedures inapplicable and excessively bureaucratic. in said Decree that were incorporated into our internal regulations.

That the possibility of updating it according to objective guidelines, taking into account the economic and financial situation of the country, is foreseen with the current economic context in successive contracts.

Likewise, the volume of purchasing and contracting processes, as well as the budget allocated to them, require more agile, efficient and economical procedures.

That innovative institutes have been maintained such as anti-corruption regulations that prevent the collision of interests; and on the other hand, new positive practices have been incorporated, such as the Annual Purchasing Plan, which generate predictability and transparency in the acquisitions made by INAMU, as well as the priority of sustainable bidders that have a commitment to environmental issues.

That the possibility of variant offer is incorporated, and particular emphasis has been placed on everything related to samples in points 4.14 and subsequent.

That through Resolution 31/2024/INAMU, the Board of Directors summoned government representatives in the field of culture of the provinces and the Autonomous City of Buenos Aires to form the Federal Assembly, which will take place on March 14, 2024 at 2:00 p.m. hours at the administrative headquarters.

That point 5) of the Agenda will deal with the “Reform of the Purchasing and Contracting Instructions, the Instructions for Internal Internal Audit Processes, the Instructions for Internal Treasury Procedures, the Instructions for Internal Systems Procedures, the Instructions for Internal Processes of the Press and Communication Area”.

That the Administration and Technical-Legal Affairs Areas have taken due intervention.

That the Internal Audit Unit of this Institute has taken prior intervention, in the terms of article 101 of the Annex to Decree No. 1344 regulating Law 24,156.

That a resolution must be issued in this regard, which is issued within the framework of the powers conferred in Law 26,801 and Resolution 193/2023/INAMU.

Thus,

THE BOARD OF THE NATIONAL INSTITUTE OF MUSIC

SOLVE

ARTICLE 1.- Resolution 178/2022/INAMU and its Annexes that comprise it are hereby revoked.

ARTICLE 2.- Approve the ordered text of the PURCHASE AND CONTRACTING INSTRUCTIONS, which is added as an Annex and forms an integral part of this Resolution, ad referendum of its approval by the Federal Assembly of the current year.

ARTICLE 3.- Register, communicate, publish, submit to the National Directorate of the Official Registry and file it in a timely manner.
