Nassira Benchergui, paraplegic, slept on the street for several weeks on her scooter in the summer of 2022. Evicted by GrandLyon Habitat for an unpaid rent billwhich she has always contested, she decided to continue her fight.
This 60-year-old woman filed a complaint with the public prosecutor in May 2023. For the time being, we do not know if this has given rise to prosecution.
His guardianship lifted
The guardianship of Nassira Benchergui was lifted on May 11 on the pronunciation of the local judge of Villeurbanne who considered “that she had all her head”. From now on, she can make her own decisions, supported by the Handimat association.
Today she lives in a one bedroom Ibis Budget in Saint-Fons. Rehoused by the prefecture, she still hopes to obtain accommodation adapted to her disability.
Evicted for 6,000 euros in unpaid rent
Nassira was evicted from her social housing in Bron in August 2022. The fault of a bill of more than 6 000 euros unpaid according to the lessor GrandLyon Habitat.
“Madame Benchergui signed a lease with GrandLyon Habitat on 01/02/2018. Despite the opening of her APL rights, she found herself in debt as soon as she entered the premises by not paying her rent, ”replies the social landlord contacted by Lyon newsat the time.
Something she denies. When we met her, at the end of December 2022, she showed us the APL transfers to the said lessor.
Unsanitary housing
The accommodation in question was substandard. The bathtub was black with dirt. Impossible for the tenant to shower there. Worse still, it was not up to standard for people with disabilities.
“The lift closed on her chair”, confided to us Florence Berrhout-Roques, the volunteer who follows her within Handimat.
A long lost legal battle…
In court, the fight was long.
The judge terminated the lease on September 5, 2019, ordering Nassira Benchergui to pay occupancy compensation and to settle the rental debt.
La Brondillante appeals the decision but finds herself lonely, with little support from her lawyers. By judgment of September 15, 2021, the Court of Appeal upheld the first instance judgment in its entirety. The lease is indeed terminated.
Six months later, in August 2022, she was evicted from her accommodation. Outcast, she sleeps on her scooter for several weeks at La Guillotière. The Handimat association ends up taking charge of it. “She was in shock,” recalls Florence Berrhout-Roques.
“She will have to undergo several operations”
Nassira Benchergui therefore filed a complaint with the public prosecutor. In the event of legal proceedings, she will be represented by Master Aminata Sonko.
“She hopes to obtain rights after her expulsion”, explains Florence Berrhout-Roques. “She will have to undergo several operations and her electric scooter is broken. It was damaged when she was on the street. »
Indeed, Nassira Benchergui was under treatment and had stopped treatment when she was homeless. Today, supported by the Handimat association, she hopes to obtain compensation and finally live in a decent apartment.
She who, however, is on the list of priority people for housing.
