Mutual property loan without the consent of the wife

Good morning everyone,

A couple in Cameroon married in 1980 under the community of property regime and then bought the house, two years later the husband mortgaged the house for a bank loan without his wife’s consent (Article 1421 of the Cameroonian civil code: husband administers alone the goods of the community. He can sell them, alienate them and mortgage them without the help of his wife). Today the bank wants to seize the house because the loan has not been repaid.

The husband and the bank had the right to enter into this mortgage agreement without the consent of the wife who, pursuant to Article 2121 of the Cameroonian Civil Code, the married woman has a legal mortgage (Article 2121.– The rights and claims of which the legal mortgage is attributed are: Those of married women, on the assets of the husband;)

If so, can the loan agreement be canceled in court?

Thanks in advance for your answers
