Mutual Divorce: A Quick and Easy Process for Amicable Separation

Mutual divorce is a quick and easy way to get divorced. A visit to the lawyer is not absolutely necessary. All necessary meetings take place by telephone or video, but of course also in person in the office if desired. An amicable divorce is ideal when everything is settled and both spouses just want to go through the divorce process.

Online Form
The necessary information for the divorce application is submitted via an online form at www.zeitler.law. It contains all the information necessary to check the legal requirements for a divorce. You will usually receive feedback via email about the information and your questions within a few days. You then decide whether the divorce application should be submitted to the family court.

Cost
These are usually the legally required court costs and attorney’s fees. Depending on the individual case, there may be a claim to an advance on costs against the spouse or to legal aid.

year of separation
In the vast majority of cases, a year of separation is necessary for divorce. Separation means absolute separation from “table and bed”, i.e. all things in common, such as shared holidays or shared bank accounts. A written declaration of separation makes sense. Unavoidable similarities are permitted, for example with regard to shared children or a shared professional activity.

Is a lawyer enough?
In an amicable divorce, the other spouse does not need their own lawyer. Amicable divorce with a lawyer means that no disputes have to be settled in the family court, for example regarding apartment, household contents, maintenance, assets, joint and several debtor settlement, etc. All of these points should be settled amicably before the divorce. In particular, a shared house can also be settled in a divorce settlement agreement. Divorce proceedings
We only apply for divorce after express authorization. The divorce petition is served on the other spouse. The other spouse does not have to file for an amicable divorce
submit your own written declaration. The family court also decides ex officio on the pension equalization, except in the case of a short marriage (three years) or the spouses have already made a formal agreement before the divorce.

Divorce date
In most cases, the actual court date for an amicable divorce is problem-free and short. Those involved are asked about their personal details and how long they have been living separately, whether they really want a divorce and whether everything else has been taken care of. The appointment often lasts no longer than 15 minutes. The divorce will usually be announced by the court at the time of the appointment.
