Mardi 1is December 2020, Alexandra Richard, sentenced for the intentional homicide of her companion in October 2016 in Montreuil-en-Caux, near Dieppe (Seine-Maritime) appealed against his conviction through his lawyer, Me Nathalie Tomasini.
“We wanted to appeal from Monday, November 30 but that was not possible”
Alexandra Richard’s trial took place before the Seine-Maritime Assize Court from November 23 to 27, 2020.
“Doubt must benefit the accused”
Before the jurors, the Tôtaise, accused of the murder of her companion, had defended the thesis of the accident. The Advocate General, in her requisitions, had also asked for the reclassification of the acts of violence having resulted in death without intention of giving it. Requests that had not been followed by the court.
“The qualification of intentional homicide is not acceptable. In the course of the proceedings, it became clear that there was doubt as to the intention of homicide on the part of my client. However, the doubt must always benefit the accused. The Assize Court could not enter into a conviction on this ground ”
The sentence imposed on Alexandra Richard, ten years of criminal imprisonment including five of safety, is also a reason for the appeal.
“This sentence is not justified. Ten years, including five of safety, for a woman who is not dangerous, who has spent the last two years in freedom and who was well integrated into society since she had an indefinite contract, it is too much “
Me Tomasini recalls that the events of October 16, 2016 in Montreuil-en-Caux concern a single and accidental shot, the epilogue of three years of proven domestic violence.
“I had my client on Monday. She was in shock. She understood that this sentence was the assurance of spending the next five years at least in prison, far from her children ”
The lawyer will apply for the release of her client pending the appeal. The latter should take place within a year.
