Municipality of Amsterdam’s Leasehold Policy: Leaseholders’ Request for Enforcement Rejected

A group of leaseholders today received the lid on their noses from the judge. The Netherlands Authority for Consumers and Markets (ACM) was right to reject their request to enforce against the municipality of Amsterdam. According to the leaseholders, the municipality would, among other things, abuse its economic position with its leasehold policy.

In addition, the municipality would engage in unfair commercial practices and impose unreasonably onerous general lease conditions. The leaseholders therefore requested ACM to enforce this.

No violation

But the supervisor did not want to respond to this request: first there must actually be a violation. In addition, the ACM expects the council to work on bottlenecks and improvement points itself and, according to them, the subject is already on the agenda of the House of Representatives. That is why they see no need to initiate an enforcement investigation now.

According to the judge, this decision is correct, although ACM should have provided better reasons why it rejected this request.
