MTPE: Workers will not be able to work without having the three doses of vaccination

Los workers who work in person may only do so under the condition of having the three doses of the vaccine against COVID-19, after a change in the regulation provision of the General Labor Inspection Law.

This week the Ministry of Labor and Employment Promotion (PEMT) issued Supreme Decree No. 004-2022-TR, which specifies this change and indicates that the companies they could commit an administrative infraction if they do not comply with the provision.

The text specifies that it is considered a very serious infraction “to order, demand or allow the entry or stay of people to provide services in the workplace, when they do not have the vaccination doses against the COVID-19required for face-to-face work activity, according to current regulations or, if exempted, failing to comply with the conditions and obligations provided for in said case, in accordance with the provisions of a ministerial resolution or regulation that replaces it of the competent Health Authority “.

The measure also indicates that they will not be able to work in person either. workers from service provider companies, or service locators, that do not have the three doses of COVID vaccines,

Regarding the fine that would be imposed on companies or employers who let their workers work without having the three doses of vaccine, it is pointed out that this will depend on how many employees were affected.

“Affected workers are considered to be the total number of people who provide services in person at the workplace in which the commission of the aforementioned infraction was warned”, they indicate in the decree.

Specialists indicate that currently the fines for companies that are classified as very serious offenses range from 2.63 UIT (S/ 12,098) to 52.53 UIT (S/ 241,638).

It should be noted that the regulations in force, as of April 1, indicate that it is mandatory for everyone over 18 years of age to have the three doses of the vaccine against coronavirus to enter public and private establishments. However, the MTPE had not yet specified how this measure would be applied to work centers.
