The MP appealed to the higher court with a request for an injunction to suspend the decision of the Rio de Janeiro Court of Justice that removed Ednaldo from office by invalidating the assembly that elected him.
The MP’s action is justified because the body is at the center of the discussion about the legitimacy of the leader’s election – the election was authorized after an agreement between the MP and the CBF.
The president of the STJ, Maria Thereza de Assis, however, understood that there was no possibility of serious harm to the CBF in the case, that is, it made no sense to issue an injunction. She alleges that there was judicial intervention in the entity due to the MP’s actions.
“In this case, the requesting party does not even develop reasons that demonstrate the real occurrence of serious damage to the assets protected by article 4 of Law 8,437/1992, but only registers that there is a “risk of serious damage to public order, security and economy to from judicial interference in the CBF”, a generic allegation that, according to the evidence, is not enough to grant the counter-caution. The argument is even strange, because if there was “judicial intervention in the CBF”, it was promoted by the Public Ministry of Rio de Janeiro, now the applicant, who filed the action against that legal entity governed by private law and forced her to sign the Conduct Adjustment Terms”, says the president of the STJD
It is the second decision of the higher court in favor of the Court of Justice’s determination and for maintaining Ednaldo’s departure. There remains one action in the STF filed by the PSD party.
At the moment, there are already discussions between leaders for the election of the CBF. Ednaldo himself is negotiating to join a single ticket with the opposition movement led by Flávio Zveiter and Gustavo Feijó.
