In a decree signed this Monday, January 18, the prefect of Moselle, Laurent Touvet endorsed the automatic resignation of Franck Roviero from his mandate as municipal councilor and from his functions as mayor of Moyeuvre-Grande.
January 7, the elected official had been heard by the Thionville criminal court in a case of domestic violence. He was sentenced to an awareness training course and to an additional five years of ineligibility with provisional execution. A criminal appeal has been lodged.
For the Moselle prefecture, it is obvious that Franck Roviero is no longer mayor of Moyeuvre, even if an administrative appeal would also be initiated against this decree because it “has no suspensive effect insofar as the criminal conviction accompanied by a provisional execution measure is comparable to a final decision, which in fact results in the immediate loss of the electoral rights of the interested ”. Only a return, in the event of a new favorable criminal judgment and compliance with administrative procedures, could be considered.
Franck Roviero has decided to cede his communication to his lawyer. Me Xavier Iochum ensures that he does not have the same interpretation of the law and intends to argue before a judge the jurisprudence of the Council of State.
The prefecture has nevertheless instructed the first deputy, François Schneider, to take over the interim while awaiting new elections within the municipal council.
