In the United States, the prosecutor in Philadelphia, Pennsylvania, announced Tuesday that he was appealing a judge’s dismissal of murder charges against a police officer who shot several times at a motorist, all the facts having been filmed.

“The District Attorney’s Office disagrees with Municipal Court Judge Wendy L. Pew’s decision to dismiss all criminal charges against defendant Mark Dial for the August 14, 2023 murder of Eddie Irizarry,” a statement said. protested Magistrate Larry Krasner. The prosecutor was going to “appeal this decision by” Tuesday evening.

Larry Krasner, known to be committed to the left and to the fight against police violence, promised to “reintroduce all criminal proceedings, including murder, against the accused”. On September 8, he announced the indictment for “murder” and “intentional homicide” of Mark Dial, a 27-year-old police officer who had surrendered to justice, but had been released.

The Philadelphia Prosecutor’s Office had released to the media a particularly violent three-minute video of the intervention of the police officer and a colleague who had slipped up, on August 14, in a neighborhood of the main city of Pennsylvania.

“Fuck, I’m going to shoot you”

The raw footage, released at the request of the 27-year-old victim’s family, was taken from Mark Dial’s body camera. We first saw the two police officers in their car, following that of the victim before the two vehicles stopped side by side and the police officers approached, on foot and armed, the driver’s door of the sedan of the victim.

The sound and jerky images showed a man shouting “I’m going to fucking shoot you” and firing six shots into the rolled-up front window of Eddie Irizarry’s car. The two officers were then seen circling around the vehicle, one of them still pointing his weapon, opening the doors, his camera filming the victim bleeding and dying in his seat.

Images rarely made public

The injured man was dragged from his car, lifted by his arms and legs into the officers’ SUV. “Transported to hospital, Eddie Irizarry died of “multiple gunshot wounds”, a death classified as “homicide”, underlined the Prosecutor’s Office at the beginning of September.

In the United States, gun violence perpetrated by police officers during traffic stops that escalate is legion and self-defense is most often invoked. But videos taken from pedestrian cameras worn by law enforcement are rarely immediately made public, just as prosecutions for “murder” are rare.
