Hello,

Our father has been deceased for 30 years, our mother has passed away. We are 8 heirs, 2 of whom are deceased (their children will inherit). There are 3 properties for sale. 2 to my father and mother and one only to my mother. On it, there is a mortgage for a loan not repaid by one of my deceased brothers. My mother signed this mortgage for 90,000 euros to get my brother out of trouble, he died eleven years later. Nobody knew about it.

Can this mortgage be considered as an advance on inheritance?

Another mortgage on a house belonging to both of my parents had also been taken for this same brother and repaid by mother before her death and after that of my brother.

These mortgages have been hidden from us, we are discovering them. Can they both be advances on inheritance. We, the 7 heirs, should we repay this mortgage and therefore our brother’s debts?
