Morena’s correction to the judicial reform does not imply its invalidity: Sheinbaum

The correction that Morena will make to the judicial reform with other modifications to the Magna Carta does not imply its invalidity, assured President Claudia Sheinbaum Pardo.

In the amendment that came into force on September 16, Morena and its allies defined in article 94, third paragraph, that the Court “will be made up of nine members, ministers, and will function as a whole. Its presidency will be renewed every two years on a rotating basis depending on the number of votes that each candidate obtains in the respective election, with the presidency corresponding to those who obtain the highest vote.

However, article 97 of the Constitution, sixth paragraph, was left untouched by the aforementioned reform and establishes that “every four years, the plenary session will elect from among its members the president of the Supreme Court of Justice of the Nation, who cannot be re-elected.” for the immediate period thereafter.

In her press conference, the head of the Federal Executive pointed out that this is a case “where the times do not agree, in one situation or another, but it does not imply any invalidity of the (judicial) reform itself.”

He indicated that this was not reviewed when it should have been and “that is why that part must be corrected.”

He specified that he consulted with the retired minister, Arturo Zaldívar, and with the legal advisor of the Presidency, Ernestina Godoy, and they told him that the reform is valid, despite the correction that will be made.
