Mexico City. The Morena bench in the Chamber of Deputies maintained that the recent constitutional reform to the Judicial Branch of the Federation “It is neither challengeable, nor reviewable, nor suspendable by any means of judicial control.”
He stressed that the Judicial Branch of the Federation itself has accepted in the past that “the Constitution is never contradictory with itself,” and that “no organ of a constituted Branch, such as a district court or even the Supreme Court of Justice of the Nation, can be above and annul the decisions made by the reviewing body of the Constitution and to whom our Magna Carta entrusts that function.”
Through a statement addressed to the Supreme Court of Justice of the Nation and the Judiciary, the Morena parliamentary group in San Lázaro indicated that “caring for the democratic system is accepting constitutional change by the methods that the Fundamental Law itself establishes.” ”, and added that this was the way in which the legislative majorities, both in the Congress of the Union and in the majority of state Congresses, approved the judicial reform.
And given the position of opposition legislators who claim that President Claudia Sheinbaum is in contempt for not complying with the suspension of a judge who ordered the withdrawal of the reform from the Official Gazette of the Federation, the cherry bench questioned: “What do these people want?” male and female legislators? That a decision made in accordance with the Constitution itself be unknown? “That a suspension be validated that – as they have all been – is issued in the face of unchallengeable acts and which no constitutional judge has the jurisdiction to issue?”
They also questioned whether opposition legislators are “on the side of the overwhelming popular majority that is represented in the Legislative Branch” or “on the side of judicial bureaucrats who issue resolutions in their favor.”
The suspensions and protections granted by judges and ministers for themselves “only corroborate the need for the reform that has been undertaken in a Judicial Branch that is alien to popular needs,” the Morenoist deputies concluded.
PVEM bench supports the president
The parliamentary group of the Green Ecologist Party (PVEM) in the Chamber of Deputies supported the decision of President Claudia Sheinbaum, to publish and promulgate the constitutional reform to the Judicial Branch of the federation, and after endorsing the way in which it was approved, stated that the Political Constitution “is above any of the three Powers of the Union.”
In addition, he asked the Supreme Court of Justice of the Nation and the members of the Judiciary to “respect the reforms approved by the Permanent Constituent,” which, he stressed, is the body empowered to reform the Constitution.
Through a statement, the Green party said that “the people of Mexico gave a clear and forceful mandate to the majority of its popular representatives” in both chambers of the Congress of the Union and in the state congresses, with the aim of carrying out the recent reform of the Judiciary.
He pointed out that “the sovereignty of the people is neither challengeable, nor reviewable, nor can it be suspended by any means of judicial control,” and maintained that these same arguments have been validated by the Judiciary itself in previous situations.
“Democracy is based on respect for popular sovereignty, the mandate of the people and respect for the Constitution, which establishes the principles that guide a new social agreement,” added the PVEM deputies.
