They had appealed against the proceedings in the first instance to be null and void, but this was rejected by the Supreme Court. The appeal hearing from Monday is about the amount of the penalty. The three main defendants had taken ten and ten and a half years in the first instance. But they demand a lower sentence, the public prosecutor a higher one.
2.1 million euros loot
The defendants are said to have robbed a money transporter on February 13, 2019 and stolen around 2.1 million euros. In the morning two money messengers wanted to fill an ATM in a Linz nightclub. They were attacked and one of them was handcuffed and gagged. The other had to drive to a parking lot on the Donaulände and hand over the money – more than 2.1 million euros – then the perpetrators fled.
During the investigation, it quickly became clear that one of the two messengers must have something to do with the matter, because the Iraqi would have had enough time to raise the alarm, but did not do so. His brother’s DNA traces were also found on the adhesive tape that was used to tie up the second money messenger.
Accused denied allegations
All of the accused, the three alleged main perpetrators and five helpers, have always denied the allegations. The three main defendants are accused of serious robbery and, in one case, money laundering as well. The five helpers were accused of stolen goods or money laundering, two have already been convicted, the others have been acquitted in case of doubt.
