Moderna suspected that BioNTech had infringed its patent since the start of the pandemic

With the coronavirus pandemic many pharmaceutical companies have set out to develop their own vaccines against the virus. Now, after more than two years of pandemic, the messenger RNA technology sparked a war of lawsuits over patents between pharmaceutical companies.

In recent months, several complaints have been filed between different pharmaceutical laboratories for infringement of intellectual property in coronavirus vaccines.

The last one was Modern contra Pfizer y BioNTech. The American company believes that the antigen of Pfizer and BioNTech infringe patents which Moderna unveiled between 2010 and 2016 and covering its messenger RNA technology.

The company claims the Pfizer and BioNTech antigen infringes the patents filed by Moderna between 2010 and 2016 on its messenger RNA technology.

In fact, according to Reutersnow, Stephane Bancel, CEO of Modernasaid the company had suspected from the start of the pandemic that BioNTech had used its intellectual property to produce a rival vaccine.

In line with its commitment to fair global access, Moderna pledged in October 2020 not to enforce its Covid-19-related patents as long as the pandemic continued.

But in March 2022, as the pandemic entered a new phase and vaccine provision was no longer a barrier to access in many parts of the world, Moderna updated its commitment. The company is now committed to not enforcing its patents for any coronavirus vaccines used in 92 low- and middle-income countries. However, Moderna expected companies like Pfizer and BioNTech to respect its intellectual property rights..
