PT Bank MNC International Tbk (MNC Bank) raises voice regarding the lawsuit worth Rp.233 billion by PT Bangun Bumi Bersatu (BBB) to Hary TanoesoedibjO. The company considers the lawsuit to be misdirected.
“The real fact is that there is bad credit by BBB as a customer of PT Bank MNC International Tbk (MNC Bank) and there is a refusal from BBB to carry out its obligations properly,” said Corporate Secretary of MNC Bank Heru Sulistiadhi in a statement to CNNIndonesia.com, Monday (25/10). ).
Heru explained the chronology of the credit agreement regarding the lawsuit. Initially, there was a credit agreement between MNC Bank and BBB as per Deed Number 23 dated August 26, 2015.
According to the deed, the credit facility ceiling provided is Rp101 billion with the provision of disbursement in 3 stages after fulfilling the stipulated covenants.
On the way, continued Heru, the disbursement of the facility was only up to stage 1 amounting to Rp51 billion and the next stage could not be disbursed because BBB was in default.
Heru detailed that BBB began to be in arrears since July 2016. Then, out of several promised projects, only one achieved progress of approximately 50 percent and stopped. BBB is also called not meeting the requirements for disbursement stages 2 and 3.
“MNC Bank has sent three warning letters/summons between August 2016 – September 2016 but they have not been heeded,” he said.
Furthermore, BBB filed a lawsuit against the law against MNC Bank as Defendant I as an effort to avoid its obligations.
On October 8, 2021, BBB had already filed a lawsuit, then case Number 399/Pdt.G/2021/PN.Jkt.Sel was withdrawn itself at the mediation hearing.
“In dealing with debtors with bad intentions like BBB, of course, MNC Bank has the full right to file a civil or criminal lawsuit against BBB,” said Heru.
For information, in the lawsuit numbered 921/Pdt.G/2021/PN JKT.SEL, PT Bangun Bumi Bersatu sued PT Bank MNC Internasional Tbk, PT Harbun Perkasa, PT MNC Investama Tbk, and PT Sapta Prima Talenta. In addition, the defendants were Hary Tanoesoedibyo, and Ati Mulyani and Vestina Ria Kartika.
BBB sued on suspicion of violating the law for diverting project receivables from loans disbursed by MNC Bank without the knowledge and consent of the plaintiffs. The allegation caused material losses of Rp. 133.07 billion and immaterial losses of Rp. 100 billion.
