Ministry of Health asks healthcare professionals not to join peaceful demonstrations regarding Health Bill discussion

Jakarta, 7 May 2023

In connection with the call for peaceful action related to the rejection of the discussion of the Health Bill from five professional organizations, the Ministry of Health requested that doctors, dentists, nurses, midwives and pharmacists not leave their services to the community.

The five professional organizations referred to are the Indonesian Doctors Association (IDI), the Indonesian National Nurses Association (PPNI), the Indonesian Midwives Association (IBI), the Indonesian Dentists Association (PDGI), and the Indonesian Pharmacist Association (IAI).

Spokesperson for the Ministry of Health dr. Mohammad Syahril said that expressing opinions is a normal thing, but don’t let their participation in the demonstration on Monday, May 8 and plans for a mass strike to serve patients in the next few days sacrifice the interests of the wider community.

“Patient care must be prioritized. Let colleagues remember our oath: I will dedicate my life for the benefit of humanity, and I will always prioritize patient health,” said dr. Syahril.

dr. Syahril also said, in accordance with Government Regulation Number 94 of 2021 concerning Discipline for Civil Servants and other provisions that apply to each health service facility, the Ministry of Health requests that doctors and health workers who work in Hospitals and Ministry of Health service units not leave the task of providing services during working hours without any valid reasons and permission from the head of the work unit.

One of the demands of the demonstrators is that the Health Bill seems to have the potential to trigger the criminalization of doctors and health workers. according to dr. Syahril, this is very unreasonable.

“Let’s not provoke as if there is a potential for criminalization. That is not true. Precisely this Health Bill adds new protection, including from criminalization efforts. We intend to protect, why are we demonstrating instead,” said dr. Syahril.

The Health Bill is currently in the discussion stage between the Indonesian Parliament and the government. Through this bill, the government proposes additional legal protection for doctors, nurses, midwives and other health workers when providing services to the public.

“The legal protection articles are intended so that if there is a legal dispute, health workers do not directly deal with law enforcement officials before there is an out-of-court settlement, including through an ethics and disciplinary trial,” said dr. Syahril.

According to Syahril, there are several new articles of legal protection proposed by the government, such as legal protection for students, the right to stop services if they experience acts of violence, and legal protection in certain conditions such as epidemics.
