A spokesperson for VWS does not rule out that they are among the exceptions for whom this is allowed.
Because it is a new situation, there is no case law about companies that only want to admit customers who are fully vaccinated against corona. Normally this is not allowed. In principle, however, the court could rule that security currently outweighs, for example, privacy or the right not to be discriminated against.
Under the temporary corona law, it is possible in four specific sectors to ask for a corona admission ticket. These are the catering industry, the cultural sector, events and professional sports competitions. And it goes less than proof that someone has been fully vaccinated, says VWS. An entrepreneur can only see on the corona app whether someone has a green check mark. Such a check mark can also mean that someone has tested negative, or has recently recovered from corona.
Need to go to court
These corona rules are linked to fixed locations. As a result, travel organizations may not be covered. They could then demand more from their customers for safety reasons. The corona rules also do not apply to enclosed places, such as homes or student societies. According to the spokesperson for Public Health, it is not clear what dance schools may ask of their customers. That should be judged by a judge.
Yesterday it was announced that a dance school in Utrecht only wants to admit students who are fully vaccinated. If necessary, the owner wants to go to court for this. According to de Volkskrant, there are at least three travel organizations that set the same requirements for their customers.
