Mexico City. The Minister of the Supreme Court of Justice of the Nation (SCJN), Alberto Pérez Dayán defended that the suspension with general effects within the amparo trial “is fundamental to defend the legitimate interests recognized by the Constitution.”
Pérez Dayán is the first member of the SCJN who, publicly, expressed his concern about the approval of the reform to the Amparo Law in the Congress of the Union, about which his next challenge by legislators from opposition before the highest court.
When participating in the “National Meeting for a Security and Justice Agenda”, Alberto Pérez Dayán also pointed out that “for many” protection is severely threatened by intolerance.
“It is the responsibility and task of everyone to protect it (the protection) in its integrity, in order to prevent this means of defense from being weakened or betrayed by any group in the legislature. I cannot help but express my concern precisely about the approval of the reform of the Amparo Law,” Pérez Dayán pointed out.
The minister explained that the suspension of the trial ensures the preventive protection of collective and diffuse rights and interests, mainly economic, social, cultural and environmental rights, the fulfillment of which is a human obligation in charge of the Mexican State.
“Will the existence of a lawsuit, whose purpose is to protect human rights, really defend and protect our future and that of our generations, if those who process it cannot prevent an activity that negatively impacts the environment from stopping?” he questioned. the judge
