Minister of Manpower Ida Fauziyah’s Criticism of JHT, Hotman Paris: Where is the Justice, Mrs. Minister?

TRIBUNNEWS.COM, JAKARTA – Well-known lawyer Hotman Paris comment on the question Old Age Guarantee (JHT).

Hotman reminded the Minister of Manpower (Menaker) Ida Fauziyah to be careful because of making a new policy on the procedure and terms of payment of benefits Old Age Guarantee (JHT).

As is known, Ida Fauziyah who is also a politician of the National Awakening Party (PKB) issued a new rule that JHT stored in BPJS Ketenagakerjaan can only be fully liquidated when participants enter the age of 56 years.

Whereas previously, JHT could be disbursed in full when a participant resigned, was laid off, or was no longer an Indonesian citizen. The JHT contribution itself is quite large, namely 5.7 percent of the worker’s salary each month.

The new rules are contained in the Regulation of the Minister of Manpower (Permenaker) Number 2 of 2022 concerning Procedures and Requirements for Payment of Benefits Old Age Guarantee.

Hotman Paris thinks that the new policy of the Minister of Manpower Ida Fauziah does not fulfill the community’s sense of justice, especially for workers or workers. The JHT money is wholly owned by the workers from their monthly salary deductions.

“Essentially, the minister in making the rules must think about reason, legal abstraction, and justice,” said Hotman Paris Hutapea through an open statement to the Minister of Manpower Ida Fauziyah through videos uploaded on his official Instagram account.

Hotman Paris said that the practice of withholding workers’ money until they were 56 years old seriously violated justice. In fact, in some cases, workers who have been laid off or who quit voluntarily are in dire need of funds.

He made an analogy, an employee who was 32 years old but was eventually laid off, then the worker had to wait for the disbursement of his JHT for 24 years.

“For more than 10 years the money was collected at JHT. That’s her money. Because according to the rules, it can only be taken at the age of 56. Where is the justice, ma’am? That’s her money,” said Hotman Paris.
