Minister of Finance Responds to Potential Lawsuit by PT Freeport Indonesia over Export Duty Policy

Minister of Finance Sri Mulyani Indrawati responded to a potential lawsuit filed by PT Freeport Indonesia regarding the export duty policy for copper concentrate exports.

Freeport’s objection arose to the rules contained in Minister of Finance Regulation (PMK) Number 71 of 2023 concerning Stipulation of Export Goods Subject to Export Duty and Export Duty Tariffs which the government had just issued.

Sri Mulyani did not want to talk too much about this. When she directly confirmed the objection and potential lawsuit, she only said that it would be discussed later.

“Later, we will discuss it,” said Sri Mulyani briefly when met at the Presidential Palace Complex, Central Jakarta, Thursday (10/8/2023).

When asked again whether there was any potential to revise the rules in question, Sri Mulyani only smiled and didn’t say a word.

Previously, PT Freeport Indonesia (PTFI) had explained about the news that the company wanted to sue the Indonesian government regarding export duty regulations.

PT Freeport Indonesia VP Corporate Communications Katri Krisnati denied the company’s planned lawsuit, instead what the company wants to do is file an objection and appeal against the determination of the export duty.

Katri said that at the end of 2018, the Government of Indonesia and Freeport-McMoRan Inc., as the shareholder of PT Freeport Indonesia (PTFI), reached a mutual agreement as outlined in the Special Mining Business License (IUPK) as a result of long negotiations regarding the divestment.

This includes policies for PTFI’s production operations in order to create optimal benefits for all of its stakeholders.

“One of the provisions regulated in the IUPK is regarding the export duty rate that applies to PTFI during the IUPK period,” he explained to detikcom.

Katri continued, his party filed an objection and appeal against the determination of the export duty.

“It is natural for every business actor to take the objection and appeal mechanism if there are different views between the customs authority and the business actor concerned in the application of customs regulations,” explained Katri.
