Minister Javier Laynez affirmed that he gave a provisional suspension against the ‘Plan B’ of the President Andrés Manuel López Obrador to protect the democratic order of the country, as well as the National Electoral Institute (INE).
Within its decision, published by the Supreme Court of Justice of the Nation (SCJN) this Monday, it indicated that the changes to the law could affect the functions of the electoral body.
“The national democratic system has as an organic guarantee the adequate operational capacity of the INE. The claimed decree produces a substantial change in the organization, structure and operation of the body itself, to the extent that it is possible that its regular operation may be compromised in the terms that it had been operating”, explained the minister.
He added that it was necessary to grant this suspension so that the changes proposed in the reform were not carried out.
“If the suspension is not granted, the acting institute would be subject to the application of the new organic scheme provided by the legislator, with the consequent budget adjustments, which would result in the disappearance of jobs and the removal of various public servants and, therefore, the necessary irreversible affectation to the capacity of the institute to fulfill the constitutional functions that it has entrusted to the citizenry”, he asserted.
Interior says that minister Laynez “exceeded”
Minister Laynez “exceeded” in suspending the electoral reforms, criticized the Secretary of the Interior, Adán Augusto López.
In an interview, the official explained that “there was no precedent” of a suspension of an electoral law, for which reason the challenge before the Supreme Court is already underway.
On a tour of Coahuila, one of Morena’s ‘corcholatas’ affirmed that “we believe that Minister Laynez exceeded himself because there was no precedent that a provisional suspension be granted in that regard.”
