The head of the ministry, Waldemar Buda, told PAP that the changes would take effect in the first quarter of 2023.

The development ministry wants to abolish the legal dualism that differentiates the construction of single-family houses with a built-up area of ​​less than and more than 70 m2.

From 3 January 2022 single-family houses of up to 70 square meters can be built. in a simplified procedure: on the basis of an application with a construction project, without a building permit, and without the need to appoint a construction manager and keep records.

The draft modification of the Building Law prepared by the Ministry of Agriculture and Technology assumes that on the basis of a notification, without the need to obtain a building permit, it will also be possible to build houses larger than 70 m2. It should be a building of no more than two floors, built for your own needs. In this case, however, it will be necessary to appoint a site manager and keep a record of the site.

In an interview with PAP, the development minister announced that the regulations will take effect in the first quarter of 2023. “Whether it will be February 1 or March 1, I don’t want to make predictions, but all those planning investments for the summer will definitely benefit from these regulations during the construction season” – said Buda.

He added that several thousand requests and opinions on the project were received as part of the consultations, which slightly extended the legislative process.

The head of the Ministry of Agriculture and Tourism announced the changes to the regulation during the summary conference of the ministry’s activity in 2022. “We are exempting single-family houses, even of several hundred square meters, from the obligation to obtain the building permit. We have a legislative process. We assume that in the first months of the new year it will be possible only after notification, i.e. informing the office of the start of such a process, said the minister.

The draft amendment to the building law expands the catalog of building objects and construction works exempt from the obligation to obtain a building permit and submit a notification. It also provides for the streamlining of the procedure for handing over properties in use. The start of use of a detached house will be possible after the construction manager submits a statement about the completion of construction and the possibility of starting use.(PAP)
