In the cities of Zurich and Winterthur, the minimum wages approved by the electorate cannot be introduced for the time being. Appeals against the two municipal templates lead to delays, as the two cities announced on Thursday.

The district councils of Zurich and Winterthur will now deal with the various appeals first. Their decisions can then be appealed to the cantonal administrative court and the federal court.

The consequences are clear: the introduction of the minimum wage has been delayed for the time being. “So nothing will change for employers and employees in Winterthur for the time being,” the city of Winterthur states in its statement.

The city of Zurich still wants to continue its preparatory work, as announced on Thursday. In order to be able to guarantee employers a certain degree of planning security, she has announced that she intends to inform them at least six months before the minimum wage in the city of Zurich comes into force.

Approaches of at least 23 francs

The SP, AL, Greens and trade unions had submitted the “A wage to live on” initiative. The voters in Winterthur approved the proposal for a minimum wage of 23 francs in June with a 65.5 percent yes vote.

This approach should apply to everyone who works in the city of Winterthur. Around 3,600 people would benefit from this, two-thirds of whom are women who work, for example, in the cleaning industry, in gastronomy or in retail.

Also in June, 69.4 percent of the people of Zurich were in favor of a minimum wage of CHF 23.90. This approach, which is reviewed annually, is intended to apply to everyone who works mainly in the city of Zurich.

Employers’ associations had announced that they wanted to take legal action against the proposal. The city announced that their appeals have now been received by the Winterthur district council. Two appeals are now also pending with the Zurich district council, as the city of Zurich announced on Thursday.

“Exploit employees for longer”

The initiative committee “A wage to live” criticizes the applicants: “It is obvious that they are only interested in exploiting dumping wage employees in Zurich and Winterthur for a few more years,” says a statement.

The appeals are legally unfounded and therefore have no chance. Before collecting signatures, the unions had checked whether municipal minimum wages were permissible. And the cities of Winterthur and Zurich commissioned a second, independent legal opinion before the ballot.

It is to be hoped that the appeals will now be given priority so that “the more than clear will of the people can be implemented as quickly as possible”. (sda)
