“Minimum Salary Increase in French Public Service as of May 1, 2023: Details and Implications”

L’order of April 26, 2023 door, from 1is May 2023, the amount of the national minimum growth wage (SMIC) gross hourly at 11.52 euros (increase of 2.22%), i.e. 1747.20 euros monthly on the basis of the legal working time of 35 hours per week.

Therefore, the decree n°2023-312 increases from May 1, 2023 the minimum salary set by the scale governing the remuneration of the public service. The decree sets the minimum salary, today corresponding to the increased index 353 (i.e. gross index 385), to theincreased index 361 corresponding to the raw index 397either €1,750.86 gross monthly.

Thus, as of May 1, 2023, the following are notably remunerated on the basis of the increased index 361:

> for category C agents :

  • the first 8 rungs of the C1 index scale (operator of physical and sports activities, social agent, administrative assistant, technical assistant, heritage assistant, animation assistant, technical assistant for educational establishments);
  • the first 5 rungs of the C2 index scale (qualified physical and sporting activity operator, 2nd class main social worker, 2nd class main specialized worker for nursery schools, 2nd class main childcare assistant, 2nd class main care assistant class, chief rural warden, guardian-brigadier, senior administrative assistant 2nd class, senior technical assistant 2nd class, senior heritage assistant 2nd class, senior animation assistant 2nd class, senior technical assistant 2nd class of establishments of education);
  • the first rung of the C3 index scale (qualified physical and sports activities operator, 1st class main social worker, 1st class main specialized worker for nursery schools, 1st class main childcare assistant, 1st class main care assistant , chief rural warden, guardian-brigadier, principal administrative assistant 1st class, principal technical assistant 1st class, principal heritage assistant 1st class, principal animation assistant 1st class, principal technical assistant 1st class of establishments of teaching);
  • the first 4 rungs of the supervisor index scale;
  • the first rung of the index scales of principal supervisor, principal chief brigadier and chief of police;

> for category B agents:

  • the first 2 rungs of the index scale of the first grade of employment executives covered by decree no. municipal police, territorial educators of physical and sports activities, lieutenants of professional firefighters, territorial editors and territorial technicians);
  • the first level of the index scales of childcare assistant and nursing assistant of normal class;
  • the first 3 rungs of the index scale for the grade of instructor-educator;
  • the first rung of the index scale for the grade of principal instructor-educator.

As in previous upgrades:

  • These regulatory provisions, which apply to all agents (civil servants and contractors), do not require the drafting of an administrative act (order or contract); if, however, you wish to issue an order (for a civil servant) or an addendum (for a contractor), you can use the attached models;
  • All contracts drawn up from May 1, 2023 must therefore now cover at least IB 397 ;
  • Appointment decrees drawn up from 1 May 2023 which lead to classifying the agent on a step of a grid whose increased index turns out to be lower than IM 361 will indicate that the agent will benefit from the salaries and allowances relating to the minimum salary index applicable in the public service until he reaches an index at least equal in his grade.
