In February 2020, American singer Miley Cyrus (29) shared a photos of himself by the paparazzi on Instagram.
However, he shouldn’t have done that. On Friday of last week, the photographer of the photo in question took legal action against the singing star. Robert Barbera states that the photo he took was shared without permission and that Cyrus made good money sharing it.

She believes, among other things, that the photo she shared contributed to the increase in traffic on the 29-year-old’s Instagram profile, which in turn created a stir around her and made her music sell better – and the artist. thus received more income.
It violates copyright
“The image was copied, archived and shared without permission, thus infringing copyright”says the photographer.
According to the website NME Robert Barbera believes that the “Party in the USA” singer’s use of the image has destroyed the potential of photography – and that it no longer holds any value to him.
And Barbera probably has the law on his side.
According to Scoreboard American copyright law is clear. Photographers own the copyrights in the images they take, and using the images without a license is a violation of copyright. The celebrity in the photo doesn’t co-own it even though it’s pictured – and they don’t even have the right to share it.
It is not known exactly how much Barbera requires in return.
This is not the first time
This isn’t the first time Robert Barbera has sought compensation from a celebrity who used his photos.
At the latest in June, the photographer sued the artist Dua Lipa (27).
According to Scoreboard at the time in the lawsuit it was alleged that “the defendant voluntarily chose to copy, archive and display the actor’s copyrighted photographs”. Similar to the lawsuit against Cyrus, the photographer also said Dua Lipa benefited from sharing her photo further in terms of exposure and increased revenue.

Barbera then asked for damages and a sum he would have earned from the photo, which was then removed from the artist’s Instagram.
