At this time of the end of the year and with the presence of Covid-19, where we all want to escape for a moment and put aside the tension due to fear of the pandemic, an airline called Interjet is lost, where the first victims are the users , workers, captains and flight attendants.
The foregoing makes me bring to the present the tragedy that was the closure of Mexicana de Aviación in the hands of the pseudo-businessman who benefited at the time of former President Felipe Calderón and, why not say it, of the Acting Attorney of the last section of Enrique Peña Nieto: me I am referring to the untouchable character Alberto Elías Beltrán (Legal and International Affairs Deputy Attorney of the then PGR). In effect, in the struggle of Mexicana de Aviación, the pilots, flight attendants and ground personnel have been “gladiators” so that the illicit acts carried out by the then president of the Board of Directors of Mexicana de Aviación do not go unpunished.
In this struggle, everything has been experienced, from the loss of jobs including the wealth of thousands of families and, why not say it, the health of several of them. It is convenient to recapitulate the history of the criminal issue against the other untouchable: Gastón Azcárraga Andrade who was accused at the time of the then Attorney General of the Republic Jesús Murillo Karam of the crimes of the securities market law and money laundering.
In relation to the crimes of the securities market law, the then Deputy Attorney in charge of the office of the Attorney General’s Office, two days after the end of the Peñista administration, requested in criminal case 47/2014, the cancellation of the orders of apprehension to the Tenth District Judge of Federal Criminal Proceedings in Mexico City, who agreed to NOT in favor of his petition; Against this, Gastón Azcárraga Andrade filed an appeal, which was resolved in criminal court 7/2019, by the Magistrate of the Second Unitary Court in Criminal Matters, Manuel Bárcenas Villanueva, confirming the refusal to cancel the arrest warrants; Against this resolution, the aforementioned employer filed the amparo trial number 17/2019, in which the Magistrate of the Third Unitary Court in criminal matters, Isabel Porras Odriozola (who curiously also decided to release the assets to Javier Duarte), inexplicably granted the amparo for the effect that the Magistrate of the Second Unitary Court could study again whether or not said cancellation of arrest warrants was appropriate.
Being the case that the indicated Magistrate of the Second Unitary Court on two occasions refused to cancel the arrest warrants as it was inadmissible, however, Isabel Porras Odriozola, Magistrate of the Third Unitary Court in criminal matters (I reiterate, who curiously also decided to release the property to Javier Duarte), illegally ordered the Magistrate of the Second Unitary Court in criminal matters to cancel the arrest warrants.
Against the aforementioned cancellation of arrest warrants, the Union Association of Aviators Pilots of Mexico filed the appeal for disagreement number 19/2020, of which it was time to hear the Sixth Collegiate Court in criminal matters, however, apparently the acting secretary of magistrate, Gabriela Rodríguez Chacón, wanted to resolve the matter in the “dark” in the session dated November 26, 2020, even without having notified the Trade Union Association of Aviator Pilots of Mexico of the admission of the appeal, however The aforementioned trade union association became aware of it and requested that it abstain from resolving the matter until the Supreme Court of Justice of the Nation ruled on its request that the highest Court of the Nation decide the case.
Thus, in the emblematic case of Mexicana de Aviación, the air bags were filled with tickets to travel to the destination of the island of the untouchables. Therefore, the attention of the authorities in this type of matter is essential so that professionals, pilots, flight attendants and ground workers are not further affected and the illegal resolutions that have been issued in the last part of the history of Mexicana de Aviación are investigated. . Today, the case of Mexicana de Aviación returns to the government’s agenda through the Secretary of the Interior, Olga Sánchez Cordero, and the Secretary of Communications and Transportation, Jorge Arganis Díaz Leal, in which the issue of untouchables should be included. so that it does not remain in the air of impunity.
The workers of Mexicana de Aviacion, especially the Asociación Sindical de Pilotos Aviadores de México (ASPA), continue their fight, now it is up to the Supreme Court of Justice of the Nation to decide first the attraction of the case and, secondly, if the arrest warrants remain in force. And if we add to this story now that of Interjet, the turbulence will be of great magnitude for what will correspond: fasten your seat belts.
