More and more resentment about the conviction of the former professional kicker Christoph Metzelder is loud, now the public prosecutor’s office in Düsseldorf is appealing against the verdict that was imposed on Thursday. However, the appeal is probably not against the sentence.
This reports “Focus Online” and refers to information from judicial circles. With the appeal, the prosecution is therefore requesting that the convicted person’s cell phone be subsequently confiscated.
The public prosecutor’s office appeals in the Metzelder case – the cell phone is subsequently withdrawn
Metzelder had been sentenced to a prison sentence of ten months on probation for owning or forwarding child and / or youth pornographic files. The 40-year-old confessed to the possession and disclosure of a total of 18 files during the trial. 297 files were found on his cell phone, which was seized in 2019. The public prosecutor’s office now wants to confiscate the cell phone as a means of crime. However, this only works if the prosecutors take action against the judgment.

According to information from “Focus Online”, the Metzelder side does not want to contradict the request to secure the cell phone. After the verdict, Metzelder’s lawyer Ulrich Sommer had also not ruled out an appeal.
In the hope of clarifying further background, he sees “there is still a lot to be discussed and legally decided for other instances,” said Sommer, who, among other things, sees the media prejudice not being sufficiently mitigated in the judgment: “That would be a matter for the revision or possibly also the calling. “(sid / abin)
