A detainee from Bron was forgotten in a shower, closed by a grid, for nearly three hours, on January 27, at the central house of Saint-Maur (Indre), revealed to the Progress his two lawyers from the Lyon Bar, Maîtres Ilié Negrutiu and Amid Khallouf.
In a reasoned letter, dated February 4, they asked the Keeper of the Seals to refer the case to the General Inspectorate of Justice. The Defender of Rights and the Controller General of places of deprivation of liberty have also been informed of the situation. A complaint is not excluded.
Their client, a 27-year-old man, “didn’t know what was going on [dans la cabine]. He typed, shouted, for three hours” to manifest himself and “wonders if it was not intentional”, considers Master Khallouf.
According to the inmate, when he was taken to the bathroom, one of the guards was obviously drunk and had hinted to him that the incident would occur.
“Subject to a rather specific regime”
“The night service found him” around 9 p.m., probably after noticing his absence in his cell.
“This event is a bit of a drop in the bucket”, whereas this detainee “is subject to a rather special regime”, according to Maître Khallouf. “He has been in solitary confinement for 20 months, despite two notices of contraindication from a psychiatrist in the establishment, in December and a few days ago”.
Le Brondillant is one of the some 350 DPS (particularly reported prisoners) , the most closely watched in France, among a prison population of nearly 73,000 people. “He is affiliated with organized crime” and is currently serving two sentences of eight and ten years in prison. He has also been indicted, since March 2021, in a case of burglaries in Swiss armories, under investigation in Lyon, for which he remains presumed innocent.
“This DPS status is chosen on a case-by-case basis, either after escape attempts, or for belonging to organized crime, or for very radicalized people like Salah Abdeslam”, list among other criteria the lawyer.
“Transferred every three months to another prison”
Concrete translation of this status: the Brondillant “undergoes security rotations. He is transferred, every three months, to another prison, to prevent him from having habits”, regrets Maître Khallouf, who evokes “conditions of detention prejudicial to his fundamental rights”.
Requested on all points, the interregional management of the prison services of Dijon only confirmed to our newspaper the episode of the shower, evoking “a professional misconduct. To shed light on the facts, requests for explanations have been launched and measures may be taken at the end.
