Medalist Gaby Agúndez wins lawsuit against Conade

The Olympic medalist Gabriela Agúndez won a lawsuit she filed against the National Commission of Physical Culture and Sports (Conade), for which the organization directed by Ana Guevara must restore the scholarship that was suspended since last year.

The diver, who together with Alejandra Orozco won the bronze medal in Tokyo 2020 in the synchronized 10-meter platform event, sued said entity last February to return her sports scholarship based on the results obtained in the World Championships. Swimming Fukuoka 2023, where he achieved fourth place in the individual platform and the silver medal in the mixed team.

To receive financial support, Conade asks athletes for the Single Sports Registry (RUD) of the Mexican Swimming Federation, which is impossible to obtain because the organization itself chaired by Guevara did not recognize the FMN. In addition, ask for a letter from the national sports association where the request for the scholarship is made, since this entity no longer exists.

Therefore, it is appropriate to grant the protection and protection of the Federal Justice, for the purpose that once this sentence is final, the authorities of the Conade issue an official letter in which they consider the requirements actually satisfied by the complainant Gabriela Belém Agúndez García and that are his responsibility, related to his application for a sports financial scholarship for the results obtained in the World Swimming Championships held in Fukuoka, Japan, in 2023, without requiring elements that are outside his legal and material scope such as those which must be issued by the competent national sports associationindicates the document of the final sentence handed down by Ulises Oswaldo Rivera González, fourth district judge in administrative matters of Mexico City.

“It is a transcendent fact because she is an Olympic medalist. It is incredible that the authorities give athletes of that level such treatment, we all know that it is revenge against these athletes. What Conade makes are excuses, not legal arguments, and every time a sentence is issued it shows that she is not acting in accordance with the law.

In this case, the judge determined that Conade cannot demand from athletes requirements that are impossible to comply with. (The ruling) is also based on the legal obligation of Conade, which among its powers and obligations is to provide the athletes who are going to represent us in the highest sporting events with the ideal means and resources to compete.explained the diver’s lawyer, Luis Jiménez, in an interview with The Conference.

He also detailed that Conade has 10 business days to submit review resourcesand indicated that, if not appealed, the resolution is retroactive and with immediate effect.

It is likely that Conade will not use this resource, as has happened previously. We think that they are tired of making fools of themselves and what they want is to get out of this.

This is the third lawsuit that Conade has lost against athletes in aquatic disciplines, after withdrawing their sports scholarships since January of last year. The other two were those presented by the artistic swimming team and the diver Jahir Ocampo.
