The Surabaya District Court (PN) legalized the interfaith marriage of a Muslim-Christian couple. vice President Ma’ruf Amin said the decision was not in line with the fatwa of the Indonesian Ulema Council (MUI).
“From the point of view of the MUI fatwa, it is not in line with the fatwa,” said Ma’ruf Amin to reporters during a visit to the central MUI office, Menteng, Central Jakarta, as shown in the video footage received detik.comTuesday (28/6/2022).
Regarding the Surabaya District Court’s decision, said Ma’ruf, the MUI Legal Commission will conduct a discussion. Because, he said, in the MUI fatwa, interfaith marriages are not allowed.
“What will it be like. The Law Commission, yes, it will be discussed at the MUI what the Law Commission will look like because the fatwa is indeed not allowed,” he said.
Ma’ruf said that the MUI fatwa regarding interfaith marriage should not have existed for a long time. Ma’ruf said that the fatwa already existed when he was the chairman of the MUI Fatwa Commission.
“If the fatwa already exists, when I was the chairman of the Fatwa Commission, there was already a fatwa,” he explained.
Viewed on the MUI website, regarding interfaith marriages, there is MUI Fatwa Number 4/MUNAS VII/MUI/8/2005 concerning Interfaith Marriages. The fatwa was enacted in Jakarta, Jumadil Akhir 1426 H/28 July 2005 M.
The fatwa is stipulated in the VII MUI National Deliberation. The fatwa was signed by the Chair of the Commission C Session for the Fatwa Sector, namely Ma’ruf Amin as chairman of the commission and Hasanuddin as secretary of the commission.
The following is the verdict of the MUI fatwa:
FATWA ABOUT DIFFERENT RELIGION MARRIAGE
1. Interfaith marriages are unlawful and illegal.
2. The marriage of a Muslim man with an Ahl al-Kitab woman, according to qaul mu’tamad, is unlawful and illegitimate.
