NEW YORK (AP) — A US Marine Corps veteran who killed an agitated passenger by choking him on the New York City subway turned himself in Friday after authorities charged him with manslaughter. involuntarily, almost two weeks after the incident.
Daniel Penny, 24, arrived at a police station and was later taken to a court where he is expected to be arraigned in the May 1 death of Jordan Neely. The incident sparked protests, although some labeled Penny a vigilante hero.
Penny did not speak to reporters Friday morning upon her arrival at a Manhattan police station accompanied by her attorneys. He also did not respond to questions thrown at him by reporters when he was escorted and handcuffed out of the police station several hours later.
Penny’s lawyers have said their client acted in self-defense when he pinned Neely to the floor of the subway car with the help of two other passengers and suffocated him for several minutes.
An independent journalist who recorded Neely struggling to free himself and then losing consciousness said that before he was subdued, the man had been yelling at other passengers and demanding money in the carriage, but had not made physical contact with anyone. Penny’s lawyers allege the man was “threatening” the passengers, but did not elaborate.
Neely’s death has caused uproar over many issues, including the way city and transit authorities treat people with mental illness, as well as homicide, race and vigilante. Penny, who is white, was questioned by police after the fact but was released without charge. Neely was black.
