– Today I issued a ban on two assemblies that were to be held on August 15 in the streets of Warsaw. Both planned events received negative opinions from the sanitary services. On Tuesday, the Mazowieckie Provincial Sanitary Inspector issued an opinion on these gatherings. “The assembly, in which about 20,000 people were declared to participate, should not be held, as it violates the current legal status” – he explained in the opinion sanelinforming that this also applies to the assembly with the declared participation of 10,000 people. According to the Department of Health, the number of participants who could take part in the assembly means that there is a risk of infection of its participants, as well as bystanders.

In this situation, the Mayor of Warsaw, Rafał Trzaskowski, issued a ban on these two meetings. “The organizer has been notified of the possibility of appealing against the decision to the District Court. This one has 24 hours to consider the case, there are another 24 hours for any appeal against the court decision. If the ban is revoked by the court, the meeting is registered and can be held” – the office informed .

The magistrate pointed out that the mayor of Warsaw must rely on the law and the opinions of specialists, and in this case, in particular, on the opinion of the sanitary inspector. “He has specialized knowledge and experience in the field of epidemiological threats“- indicated the town hall.

At the same time, it was recalled that the freedom to organize peaceful assemblies and to participate in them is one of the basic elements of constitutional freedoms, but cannot be unconditional. “The Law on Assemblies mentions the possibility of endangering the life or health of participants as one of the reasons why an assembly may be prohibited. In accordance with the regulation of the Council of Ministers of August 7, the maximum number of assembly participants” cannot be more than 150 people“- the office pointed out.
