June 2023.- On 2/15/2023 the Superior Court of Justice. of Extremadura overturned a sentence of the Social Court 5 of Badajoz that, although not sufficient, recognized the guilt of Correos for non-compliance in the matter of prevention regulations with violation of fundamental rights, specifically the right to physical and moral integrity.

In this way, the suffering suffered was shelved and, for years, in a stealthy and constant way, Raquel, a Mérida Post Office worker, was cornered. This process of harassment and discrimination by managers and her environment led the worker to a major health crisis, with almost two years of sick leave.

At work everything was obstacles, impediments, slights, bad gestures. Anything was cause for tension; request the uniform, work material, vacations, permits, reconcile your maternity, daily incidents, etc. The reprimands were sought by his headquarters and in many cases in a scandalous way. Despite reporting a multitude of incidents in writing, Correos did nothing.

A single mother with no roots in the place, they manage to isolate her and create a hostile environment around her. The discrimination in her treatment was evident and, little by little, she undermined her health until she fell ill in November 2018.

Forced to register in October 2020, by all means she tried to get the incorporation to be in another work center, one of the many that Correos has, but the position was inflexible.

The compañera was forced to suffer or leave the Post Office. With a report of consequences from the INSS and a multitude of medical reports, the public company did not do the least to take action. The obligatory Psychosocial Risk Assessment was not carried out either, to assess and tackle them. The medical examination upon joining was not carried out by a specialist in Psychiatry/Psychology as recommended by the Post Office’s own Labor Doctor.

Requested the opening of the Protocol Against Postal Harassment in October 2019, this took 9 long months to activate, its development was very poor, violating the secrecy of the complaint, which was provided in full to the direct boss and main accused and concluding against the worker in February 2021. On 2/9/2021 a complaint was filed with the Badajoz Labor Inspectorate to intervene in this case.

The antecedents that were presented to him were: There was a long-term conflict of hostility expressed with documents by the colleague. This conflict with the head of his workplace was known to the company (Correos) The obligatory security measures had not been established. prevention. (Ev. Psychosocial Risks) There have been damages to Raquel’s health, demonstrated in almost 2 years of sick leave, medical reports, report from the INSS Medical Evaluator and expert report from one party. None of the palliative measures contemplated in he Protocol Against Postal Harassment; no change of center, no mediation… nothing, despite having repeatedly requested it in writing.

Despite all these factors, the Labor Inspectorate does not propose a sanction, but rather a very late request to the Post Office to carry out the Psychosocial Risk Assessment. This resolution serves as support to the High Court to underestimate the breaches in matters of prevention by Correos and together with other interpretations favorable to the public entity, it rejects all the petitions of the worker and acquits Correos, annulling the previous sentence.

With this sentence of the TSJ of Extremadura, and with these resolutions of the Labor Inspectorate, breaches of prevention are left unpunished, they do not compensate the damages to the worker and the breeding ground is created so that the phenomenon of Workplace Harassment continues to be implanted in the Post Office and even be reinforced.

As a protest against this sentence, and the actions of the Labor Inspectorate -which highlight the impunity of public companies such as the Post Office, to denounce and make visible the phenomenon of LABOR HARASSMENT-, we have already called a concentration in the TSJ of Extremadura in Caceres.

On June 1, we began the “MARCH ON FOOT AGAINST WORKPLACE HARASSMENT AND POST OFFICE IMPUNITY”.

There have been 15 stages and we have walked 303 kilometers to the headquarters of the Supreme Court in Madrid.

Today Tuesday, June 13 at 8:30 pm, in the Plaza Segovia de Navalcarnero we summon the media.

In addition, we will be on Thursday 15 at 10 am in front of the Supreme Court, in Pza. Villa de París, Madrid.
