The demonstration was carried out as a form of protest from the residents because the Police named Amaq Santi as a suspect, as a result of defending himself from a robbery act.

At that time, Amaq Santi was confronted by four robbers and a fight broke out using sharp weapons.

Amaq Santi also managed to kill two robbers with the initials PN (30) and OWP (21), while the other two fled.

But recently Amaq Santi was named a suspect by the Central Lombok Police.

The police explained that in Indonesia taking the law into its own hands is a prohibited act, because it is a non-criminal offense.

“So you have to run like that? Leave the motorbike,” said the reporter.

“And don’t kill the thugs like that,” he added.

Police Commissioner Ketut Tamiana said that killing in Indonesia is a prohibited act for anyone, because it is protected by law, even though those killed are criminals.

Criminal expert response

Professor of Criminal Law at the Faculty of Law of Indonesia (FHUI) Indriyanto Seno Adji said that law enforcement should not look at the incident from the perspective of the victim’s possession of sharp weapons (sajam).

This resulted in the victims of robbery being made suspects by the police.

“Law enforcement should see it not from the perspective of the positivistic legalistic rigidity of ownership of the victim’s weapon. So that the victim is placed in his position as a suspect,” said Indriyanto when contacted by Kompas.com, Thursday (14/4/2022).

According to Indriyanto, the understanding of law enforcement is too rigid in responding to regulations that are not in accordance with the actual legal conditions.

According to Indriyanto, law enforcement must look at a case from aocial and defence protectionso it is not appropriate if the victim of robbery is made a suspect.

“So that the unlawful nature of the possession of the victim’s weapon and from the perspective of the principle of justice the victim does not deserve to be positioned as a suspect according to the principle of being against material law with a negative function,” he explained.

Self -defense

Even though he has been named a suspect in a murder robbery, the victim can lose his unlawful nature. This is because the victim is defending himself.

On the other hand, law enforcement authorities should have determined the robbers as the real suspects in the case.

“It is law enforcers who have to place the real robbers or real actor as a suspect and not create an exaggerated antithesis,” he explained.
