From 15 October the Green pass will be mandatory for workers, both for private individuals and public employees. The President of the Republic, Sergio Mattarella, has signed and issued the decree law that now will be published in the Official Gazette.
What is the risk of the worker who does not have them? With the introduction of the obligation they are foreseen fines of up to 1,500 euros for those found without a certificate. The decree passed in the Council of Ministers also provides the suspension and stopping of the salary for those without green certification, but not dismissal.
More specifically, “staff access to the workplace” without the Green Pass is punished with an “administrative sanction of payment of a sum of between 600 and 1,500 euros”. Workers who arrive at the workplace without a Green Pass will be suspended from work and without pay. The employee without a vaccination passport is, in fact, “considered unjustified absent and, starting from the fifth day of absence, the employment relationship is suspended until the aforementioned certification is presented and, in any case, no later than 31 December 2021, and, in any case, without disciplinary consequences and with the right to retain the employment relationship “.
For the period of suspension, workers without a Green pass are “considered unjustified absentee, and are not due wages or other remuneration or emolument, however called. In any case, workers retain the right to maintain the employment relationship”. In summary, no layoffs.
Fines not only for employees but also for employers who do not control. The legislative decree approved by the Council of Ministers today on the extension of the vaccination passport foresees in fact that they are to check, with fines – for those who do not – ranging from 400 to a thousand euros.
