Man Convicted of Fraud for Receiving False Disability Allowance in France

Fraudulent practices are on the rise in France. Between toll fraud, identity theft and hacking, we no longer forbid anything when it comes to getting our hands on other people’s money. This is particularly the case of the man from Cambrai, convicted of fraud for a total amount estimated at 28,892 euros. This is no ordinary theft. This 38-year-old man had made a false statement in order to improperly receive a disability allowance.

The man was initially eligible for this allowance due to his disability. The catch is that he moved to Morocco. He did not inform the authorities of his move and therefore continued to receive the allowance. To do this, this man had used his mother’s address in Cambrai. Moreover, he had omitted to declare his marriage in Morocco.

A fraud which earned him 28,892 euros in reimbursement to CAF

During his trial, the man claimed that he had no intention of staying in Morocco, but he was forced to. He had told the judge that he had divorced and lost his job and circumstances had forced him to stay in Morocco. Moreover, he had admitted that he was not aware of the obligation to reside in France to benefit from these allowances. The lawyer for the family allowance fund (CAF) confirmed that the man did indeed know that he was no longer entitled to this allowance and encouraged his mother to make a false statement and provide him with a certificate of ‘accommodation.

According to the prosecutor, the seriousness of the fraud lay in its long duration and in the fact that it involved funds coming from social benefits: “the problem is the duration of this fraud which concerns money coming from social benefits social “, she explained.

At the end of the trial, the man was sentenced to a ten-month probationary sentence over two years. He is also deprived of his civic rights for a full year. His mother, meanwhile, received a simple five-month suspended sentence. The two acolytes are also required to reimburse the sum of €28,892 to CAF.

As a reminder, since July 1, a firmer protocol has been put in place by the government to precisely counter this type of social fraud. “ Allowances and social benefits, excluding pensions, must be paid into accounts domiciled in France or in the Sepa areas “, declares Public Senate.

This system requires French people benefiting from the various social allowances to justify a residence of at least six months per year. A period that will extend very soon to reach nine months. This extension will make it possible to better control this type of fraud.
