The man in his 50s has been convicted of breaching the Animal Welfare Act when he subjected his dog to violence in August 2022. Among other things, he allegedly lifted it up by the scruff of the neck, shook it vigorously and inflicted several blows on its head and/or body. He was also convicted of violating the Dog Act.
When the case against the man took place, he pleaded not guilty to the indictment decision regarding the breach of the Animal Welfare Act, but he partially pleaded guilty to the indictment which went to the breach of the Dog Act.
In the conclusion of the judgment, it appears that the court finds that the man explained himself credibly about the incident, but that he downplayed the use of force and the circumstances surrounding the incident. Furthermore, when assessing the evidence, the court has placed decisive weight on the witness statements in the case.
The man in his 50s has also been sentenced to a fine of NOK 5,000, as well as to pay court costs of NOK 3,000.
In the judgment from the district court, it also appears that the execution of the sentence is postponed with a probationary period of two years.
