The insurance company of the South Tyrolean medical company has paid over 27 million euros in damages in the last 10 years.
Franz Ploner (Team K) observed that medical, medical and nursing errors of various degrees would inevitably occur in the outpatient services provided annually in the various structures and outpatient clinics of the South Tyrolean medical service and in the numerous surgical/interventional operations.
There are probably hundreds of patients who take legal or extrajudicial action against the medical service if medication errors are suspected.
Many procedures would be introduced through patient advocacy.
That said, Ploner requested answers to the following questions:
How many legal proceedings have been filed by patients and relatives and through patient advocacy against the healthcare facility in recent years? How many of these were settled in court and how many were settled out of court by the state arbitration panel? How much court costs did the medical services company have to pay in the period 2017-2022? What damages did the medical service company have to compensate for proven medication errors in the period 2012-2022? What is the damage amount paid by the insurance company? Is there a separate fund for medication errors (judicial and arbitration committee) in the budget of the medical facility? If yes, how gifted is he?
According to Governor Arno Compatscher there have been an average of 180 procedures in each of the past few years, with a downward trend. On average, five cases are filed through the Ombudsman Board each year and about 30 through the state arbitration panel.
An arbitration panel procedure lasts on average about one and a half years. The medical company has taken out insurance, all costs for court costs and damages are covered by this, there is no deductible.
Overall, the amount of damage covered by the insurance from 2012 to 2022 was approximately 27,165,900 euros, but it is not yet the definitive amount because there are still ongoing proceedings. There is no fund because there is no deductible.
