Major Changes Coming for Federal Public Servants in 2024

In the coming months, various regulations and laws will come into effect that will bring crucial changes for federal officials. Among other things, disciplinary proceedings are to be accelerated, there are new rules for sick days for children and a new federal aid regulation.

Public service: The federal government is planning faster disciplinary procedures

The federal government wants to remove “enemies of the constitution” from service more quickly. To this end, it passed a law in December that will come into force on April 1st, as the Federal Ministry of the Interior announced at the request of Public Service News.

The main changes for federal civil servants are as follows:

  • Instead of applying for removal from civil service status and other status-relevant disciplinary measures through lengthy disciplinary proceedings before the administrative courts, the disciplinary authorities themselves should issue these to the civil servants.
  • A final conviction for sedition will lead to the loss of civil service rights with a prison sentence of 6 months or more (instead of one year).
  • A stricter regulatory regime will also be introduced for part-time work by former civil servants in the private sector, especially if security-relevant knowledge is available, as well as a civil service permit requirement for part-time work for a foreign power.

More child sick days for federal civil servants

For 2024 and 2025, the child sick days for employees subject to social insurance contributions have been increased:

  • per child and parent from 10 days to 15 days and
  • for single parents from 20 days to 30 days.

The increase corresponds to the agreement in the coalition agreement (section Time for Family). The law came into force on January 1, 2024 and thus seamlessly follows the pandemic-related legal expansion of the entitlement to 30 days per child and parent, or 60 days for single parents, which expired on December 31, 2023. It is intended to implement the changes as systemically as possible and also for a limited period of time by amending the Special Leave Ordinance (SUrlV) in the civil service sector retroactively to January 1, 2024:

  • If the requirements of the SUrlV are met, civil servants will receive up to 13 working days of special leave for the period 2024 and 2025 with continued payment of salary. This corresponds to a system-appropriate adjustment to the sick pay payment, which generally includes 90 percent of the lost net wages as gross of the insured person’s wages subject to contributions.
  • The special situation of single parents is taken into account. Therefore, single parents will receive 26 days of special leave with continued payment of salary.
  • If there are several children, a system-appropriate adjustment to the upper limit will be introduced in accordance with the requirements of Section 45 Paragraph 2 a SGB V.

Special leave from the federal public service: the level of salary is no longer relevant

Furthermore, the previous differentiation in the SUrlV of the scope of the special leave entitlement based on the level of salary when caring for a sick child will be abandoned, the Federal Ministry of the Interior announced at the request of Public Service News.

This system change is advisable from a compatibility perspective and also with a view to the attractiveness of the federal government as an employer. The federal government is also adapting its regulations to the majority of the regulations of the federal states, which also grant the right to special leave uniformly and independently of the level of salary.

Choice of gender information in the public service

In addition, for federal employees for whom neither the gender “female” nor “male” is entered in the civil status register, an option to choose the official title will be introduced in the Federal Salary Regulations. The details as well as the date of entry into force of this law remain subject to the currently ongoing parliamentary procedure; the Bill The Federal Ministry of the Interior announced that it is currently being discussed in the Federal Council and will then be discussed in the Bundestag.

Federal public service: New aid regulation as of April 1st

In addition, the Tenth Ordinance amending the Federal Aid Ordinance (BBhV) is expected to come into force on April 1, 2024. With the amendment to the BBhV, changes in benefits in statutory health insurance law that have come into force since the last amendment to the Federal Aid Ordinance will be transferred into federal aid law with the same effect and the need for changes that have arisen in the practical application of the Federal Aid Ordinance will be taken into account.
