Major Change in Organ Donation Process in Peru: Relatives Cannot Oppose Donor’s Decision

By: María de los Ángeles Serrano

In an exclusive interview with Latina Noticias, Juan Antonio Almeyda Alcántara, General Director of the General Directorate of Donations, Transplants and Blood Bank of the Ministry of Health (Minsa), provided details about the recent promulgation of Law No. 31756, which establishes significant changes in the organ donation process in Peru.

RELATIVES WILL NOT BE ABLE TO CHANGE THE DECISION TO DONATE ORGANS

Almeyda highlighted three fundamental points contained in the new legislation. The first is the «respect for individual decision«. Almeyda stressed that there have been cases where the family opposes the donation despite the will expressed in the National Identity Document (DNI).. Now the family will not be able to oppose the decision of the potential donor.

«Despite the fact that the DNI said ‘Yes’, the family was opposed to the donation. In this case, the family will no longer be able to oppose the decision of a possible candidate.

Another crucial aspect of the law is the so-called “present consent”, which establishes that all citizens will be considered donors unless they express otherwise. Those who do not wish to be donors must explicitly express their decision not to be..

The third point addressed by Almeyda is the implementation of a national campaign to promote the culture of donation in the country. With approximately 7,000 people on the waiting list for transplants, the aim is to raise awareness among the population about the importance of donating organs and increase the donation rate in Peru.

WHEN WILL THE REGULATION BE KNOWN?

Likewise, the specialist emphasized that the regulations of the law, which will define the specific procedures, are expected to be ready by finals of February. This is because it is coordinating with Reniec to establish how people will express their willingness to be or not be donors when renewing their DNI.

However, he announced that registration will not have a cost, since it will be carried out at the time of renewal of the identity document.

«If your DNI says no, it will be valid until the DNI is expired. In the new DNI, all people will have to register and express that will. It is just becoming clear what the specific procedure will be like to express this will or not. There will be no cost for registration, because it is at the time of renewing the Identity Document,” Almeyda asserts. “When the DNI is renewed, this change is made, there is no additional cost or anything,” she added.

MINSA ON TYPES OF DONORS

Regarding donors, Almeyda explained that there are two types: living donors and cadaveric donors.

Los living donors They are those who donate an organ, such as a kidney, to a close relative. The cadaveric donors They are brain dead people whose organs can be used for transplants. He noted that the process of obtaining cadaveric organs is only carried out in authorized health facilities.

«They have to be brain dead and it is verified whether the person has not expressed their refusal or not to be a donor. Then we proceed to rule out that the person has a disease, for example, pneumonia or cancer. “A quick evaluation has to be done to see that there is no contraindication and then look at compatibility issues,” he noted.

IN 2023 THERE WERE ONLY 55 DONORS

Almeyda also confirmed that Peru has a low donation rate compared to other countries. The pandemic significantly affected donation; However, with overcoming it, the indicators are improving. The country reached 1.5 donors per million inhabitants last year, with 55 effective donors.

“There have been 55 donors who have been able to become effective, who passed all the tests, who do not have any contraindications, who had nothing against them and who have been able to be donors,” he said.

The General Director of the General Directorate of Donations, Transplants and Blood Bank of the Minsa concluded by emphasizing the importance of raising awareness about donation and encouraged the population to consider donation as a way to save lives.
