Maintenance payments: a reform to reduce unpaid debts

The reform put into service since 1is January could significantly reduce the number of unpaid child support payments. In any case, this is the objective announced by the government, which Emmanuel Macron will come to defend in person, Tuesday, January 5, during a trip to the Family Allowance Fund (Caf) in Tours (Indre-et -Loire).

From now on, if one of the two parents wishes, the payment of the pension will not be made directly between the father and the mother. But it will be the Cafs that will serve as intermediaries. A father, for example, will pay this pension monthly to the Caf, which will pay it to the mother.

Who is concerned ?

All the couples who are going to separate, but also those who are already separated. This new device has been experienced since October : 10,000 people have benefited. It is now generalized. In France, around 400,000 separations are recorded per year and, each year, 900,000 to one million parents benefit from alimony (the average amount being € 170 per month).

How many unpaid pensions?

According to the Élysée, 30 to 40% of pensions are not well paid. In other words, they are not paid, or paid late, or even occasionally. Some 350,000 people would thus be victims of these unpaid debts: mostly women, since most pensions are paid by fathers and 85% of single-parent families are made up of single mothers.

What were the remedies until then?

In addition to recourse to the courts, since 2017 there has been a collection agency (l’Wing) within Cafes, in the event of unpaid bills. However, this remains little known and required action on the part of the injured parent. at each unpaid, recalls the Elysee. From now on, one of the two parents will be able to request that the Caf serve as an intermediary from the official separation, without any unpaid debts: either to the family court judge, or by contacting the Caf. Once the system is in place, it will last until the couple’s children are 18 years old.

What happens in the event of unpaid bills?

The Caf will turn to the recalcitrant parent and will itself pay the amount of the monthly payment to the creditor parent. If the procedure is delayed a little, the injured parent may receive a provisional family support allowance (116 € per month and per child). We were inspired by a Quebec system where the proportion of unpaid debts fell to 4%, specifies the entourage of the Head of State.

What is the cost of this reform?

Four hundred and fifty additional agents will be recruited in the Cafes and in the registries. 85 million euros must be budgeted in 2021 and 122 million in 2022.
