Cristalino David Ozora alias David (17) became a victim of the brutal abuse of the child of a former tax official, Mario Dandy Satrio (20). The Coordinating Minister for Political, Legal and Security Affairs Mahfud Md urged the police to apply 2 articles of severe maltreatment in the case.
“Earlier I had discussed with legal advisers and of course the activists and enforcers of humanity, this case must be completely resolved legally. The law has set limits on what types of acts are punished with what,” said Mahfud after visiting David at the hospital Mayapada on Tuesday (28/2/2023).
“Sometimes for negligence, we apply the lightest article and provide education. But many articles are often added or included as alternatives, so that when we educate the community, other members of the community can also be deterred and afraid of doing the same thing. ,” he added.
Furthermore, Mahfud asked the police to apply 2 articles of severe persecution, namely 354 of the Criminal Code and 355 of the Criminal Code. According to Mahfud, the two articles were deemed more appropriate for the perpetrators and fair for the victims.
“Therefore, in this case, if we look at the actions that were so brutal without humanity, I may somewhat agree that Article 351 is applied, because it is indeed possible, but I would be much more in agreement and support trying to apply a stricter article, to to make young children, to make parents educate their children well, Articles 354 (KUHP) and 355 (KUHP) are applied,” he said.
“So that it can be tougher, firmer, and normally I hope, I ask for professional law enforcement officers, not to play around, because people now know easily, wow, there is an attempt to hide this, there is an effort to divert this, to obscure this, that society it’s easy to know now. Therefore, it must be truly professional so that this problem becomes legally complete for the perpetrators and justice for the victims,” explained Mahfud.
The following reads Article 354 of the Criminal Code and 355 of the Criminal Code
1. Article 354 of the Criminal Code reads
(1) Whoever intentionally seriously injures another person, is punished for causing serious maltreatment, with a maximum imprisonment of eight years.
(2) If the act results in the death of the person, the guilty party shall be sentenced to imprisonment for up to ten years
2. Article 355 of the Criminal Code reads
(1) Serious persecution committed with premeditation shall be punished by a maximum imprisonment of twelve years.
(2) If the act causes the death of the person, the guilty person is sentenced to imprisonment for up to fifteen years.
In the case of assaulting David, the police have named two suspects, namely Mario Dandy Satrio and his friend, Shane.
Mario Dandy Satrio was charged with Article 76c in conjunction with Article 80 of Law Number 35 of 2014 concerning Amendments to RI Law Number 23 of 2002 concerning Child Protection subsidiary Article 351 paragraph 2 concerning Serious Abuse.
Meanwhile, Shane, who is Mario’s friend, and the new suspect in the case are being charged with Article 76 letter C in conjunction with Article 80 of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection.
