Coordinating Minister for Political, Legal and Security Affairs Mahfud Md dismantling the modus operandi of judges can buy and sell articles. He said that this is usually done by judges who do not have integrity.
“To win, this is the article, here is the law. If you lose, this is the article, here is the law,” said Mahfud as a speaker at the commemoration of the 70th anniversary of the Indonesian Association of Judges, Monday (20/3/2023).
Mahfud said that it was the practice of buying and selling articles that often led to differences in decisions between judges, lawyers and prosecutors. He said that at this time there was a strong force between law enforcers.
“That’s why there are often differences between judges, lawyers, judges, prosecutors, prosecutors, attorneys. Because each has an article so you just stay strong and if your morals are weak your integrity is weak, that’s where buying and selling happens,” he said.
Besides that, Mahfud said, the judge could make articles that would be charged against the defendant. Therefore, it takes moral integrity to decide a case.
“But like I said, the articles can be made anything. Mr. Rocky Gerung argued against me against Mr. Bagir. ‘Sir, how about this? I just have to say, sir, okay, if you want to win, I can use this article.’ no later I win Pak Bagir. There is this law, it’s the law on cooperatives you win, but if I use the Customs Law it’s up to you. How much do you want to pay?’ People don’t have integrity,” he said.

Furthermore, Mahfud alluded to President Joko Widodo’s order (Jokowi) to reform the judiciary. Mahfud also stated that this could not be done. Because the government should not interfere in the judge’s decision. Because of that, once again Mahfud spoke about the importance of the integrity of judges.
“But I said I don’t always respect the judge’s decision. I can’t avoid the judge’s decision and participate, but I will fight because fighting is also part of the law,” said Mahfud.
