In the contract for the sale of the Bulgarian assets of CEZ to “Inercom” there is a clause requiring the buyer company to cooperate in the case against Bulgaria at the International Center for Settlement of Investment Disputes.

This is reported by “Hospodarski Novini”, citing a source from the management of the Czech company, as reported by Vesti.bg.

If CEZ’s claim against the Bulgarian state in the Washington-based arbitration is satisfied, the compensation could reach nearly 600 million euros.

This is the main reason why the Czech company does not want to sell its business in Bulgaria to the government in Sofia.

“Now imagine how we will agree to the owner of our Bulgarian company becoming someone against whom we are conducting an arbitration dispute for such an amount – we simply cannot allow it,” the source of the Czech media points out.

According to “Hospodarski Novini”, CEZ is currently preparing a new strategic option – to agree to sell a controlling stake in the Bulgarian government, if it agrees to pay certain compensation in the case in the arbitration court.

In most cases, even if such a claim is satisfied, the damages awarded are much lower than the maximum amounts, so the Czech company does not risk anything.

With the best development of events for CEZ, the company can earn over half a billion euros from the sale of its business in Bulgaria.

Meanwhile, Czech Deputy Minister of Finance Ondrej Landa, who is a member of CEZ’s supervisory board and who was alleged to have sent Bulgarian Prime Minister Boyko Borisov data on the sources of financing for the deal with “Inercom Bulgaria”, categorically denied that he did such a thing.

“I don’t know what the Bulgarian media are writing, I don’t communicate with the Bulgarian government,” Landa pointed out.

At the moment, the owner of “Inercom” Ginka Varbakova is in the Czech Republic to negotiate with the Bulgarian state to buy a stake in “CEZ Bulgaria”.

It was officially announced that the agreement between Borisov and Varbakova was that “Inercom” and the state would be partners, but that the cabinet would keep control over the energy distribution company. And the businesswoman is in Prague to convince CEZ to agree to this contract.
